i\u015f ili\u015fkisi kurma yetkisinin iptali\u201d ba\u015fl\u0131kl\u0131 18 inci maddesinde;<\/p>\n<p>\u201cKurumca verilen \u00f6zel istihdam b\u00fcrosu kurma izni;<\/p>\n<p>a) \u0130zin verilmesi i\u00e7in aranan \u015fartlar\u0131n kaybedilmesi veya ta\u015f\u0131nmad\u0131\u011f\u0131n\u0131n sonradan anla\u015f\u0131lmas\u0131,<\/p>\n<p>b) 6098 say\u0131l\u0131 Kanunun 26 nc\u0131 ve 27 nci madde h\u00fck\u00fcmlerine ayk\u0131r\u0131 davran\u0131lmas\u0131,<\/p>\n<p>c) Kurumdan izin almaks\u0131z\u0131n ge\u00e7ici i\u015f ili\u015fkisi faaliyeti y\u00fcr\u00fct\u00fclmesi,<\/p>\n<p>\u2026<\/p>\n<p>j) On iki ay boyunca hi\u00e7bir i\u015fe yerle\u015ftirmeye arac\u0131l\u0131k ger\u00e7ekle\u015ftirilmemi\u015f olmas\u0131,<\/p>\n<p>durumlar\u0131nda (a), (c) ve (j) bentlerinde belirtilen durumlar\u0131n tespiti h\u00e2linde derh\u00e2l; di\u011fer bentlerde say\u0131lan durumlarda ise son fiilin tespit b\u00fcrolar\u0131n\u0131n kurulmas\u0131, faaliyet alan\u0131, ge\u00e7ici i\u015f ili\u015fkisi kurma yetkisinin verilmesi ve denetimi\u201d ba\u015fl\u0131kl\u0131 17 nci maddesinin son f\u0131kras\u0131nda \u201c\u00d6zel istihdam b\u00fcrolar\u0131 hakk\u0131nda bu Kanunda h\u00fck\u00fcm bulunmayan h\u00e2llerde,\u00a0<a href=\"https:\/\/www.alomaliye.com\/2003\/06\/10\/is-kanunu-4857-sayili-kanun\/\">4857 say\u0131l\u0131 Kanun<\/a>\u00a0ile 11\/1\/2011 tarihli ve\u00a0<a href=\"https:\/\/www.alomaliye.com\/2011\/02\/04\/turk-borclar-kanunu-6098-sayili-kanun\/\">6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu<\/a>\u00a0h\u00fck\u00fcmleri uygulan\u0131r.\u201d<\/p>\n<p>Yine 4857 say\u0131l\u0131 Kanunun 7 nci maddesinde;<\/p>\n<p>\u201c\u00d6zel istihdam b\u00fcrosu arac\u0131l\u0131\u011f\u0131yla ge\u00e7ici i\u015f ili\u015fkisi, T\u00fcrkiye \u0130\u015f Kurumunca izin verilen \u00f6zel istihdam b\u00fcrosunun bir i\u015fverenle ge\u00e7ici i\u015f\u00e7i sa\u011flama s\u00f6zle\u015fmesi yaparak bir i\u015f\u00e7isini ge\u00e7ici olarak bu i\u015fverene devri ile\u2026.<\/p>\n<p>\u201cGe\u00e7ici i\u015f\u00e7i sa\u011flama s\u00f6zle\u015fmesi ikinci f\u0131kran\u0131n (a) bendinde say\u0131lan h\u00e2llerin devam\u0131 s\u00fcresince, (b) ve (c) bentlerinde say\u0131lan h\u00e2llerde s\u00fcre s\u0131n\u0131r\u0131 olmaks\u0131z\u0131n, di\u011fer bentlerde say\u0131lan h\u00e2llerde ise en fazla d\u00f6rt ay s\u00fcreyle kurulabilir.\u201d<\/p>\n<p>\u201cS\u00f6zle\u015fmede belirtilen s\u00fcrenin dolmas\u0131na ra\u011fmen ge\u00e7ici i\u015f ili\u015fkisinin devam etmesi h\u00e2linde, ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren ile i\u015f\u00e7i aras\u0131nda s\u00f6zle\u015fmenin sona erme tarihinden itibaren belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmesi kurulmu\u015f say\u0131l\u0131r.\u201d<\/p>\n<p>H\u00fck\u00fcmleri yer almaktad\u0131r.<\/p>\n<p>Yukar\u0131da a\u00e7\u0131klanan h\u00fck\u00fcmlere g\u00f6re, \u00f6zel istihdam b\u00fcrosu ve \u00f6zel istihdam b\u00fcrosu gibi hareket eden ger\u00e7ek ve t\u00fczel ki\u015filer ile hizmet verdikleri ger\u00e7ek ve t\u00fczel ki\u015filer aras\u0131nda kurulan ge\u00e7ici i\u015f ili\u015fkisinin 4857 say\u0131l\u0131 \u0130\u015f Kanunu ile 4904 say\u0131l\u0131 Kanunda yer alan d\u00fczenlemelere uygun kurulmamas\u0131 halinde \u00f6zel istihdam b\u00fcrosu ve \u00f6zel istihdam b\u00fcrosu gibi hareket eden ger\u00e7ek ve t\u00fczel ki\u015filer taraf\u0131ndan bildirimi yap\u0131lan sigortal\u0131lar\u0131n bunlardan hizmet alan ger\u00e7ek ve t\u00fczel ki\u015filerin sigortal\u0131s\u0131 olarak say\u0131lmas\u0131 gerekti\u011fi Bakanl\u0131\u011f\u0131m\u0131z taraf\u0131ndan 03.11.2023 tarihli yaz\u0131 ile talimatland\u0131r\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Bu nedenle 4857 say\u0131l\u0131 \u0130\u015f Kanunu ile 4904 say\u0131l\u0131 Kanunda yer alan d\u00fczenlemelere uygun ge\u00e7ici i\u015f ili\u015fkisi kurulmad\u0131\u011f\u0131n\u0131n tespitinin sonucu olarak \u00f6zel istihdam b\u00fcrosu ve \u00f6zel istihdam b\u00fcrosu gibi hareket eden ger\u00e7ek ve t\u00fczel ki\u015filer ile bunlardan hizmet alan i\u015fverenlikler aras\u0131nda as\u0131l i\u015fveren-alt i\u015fveren ili\u015fkisi kurulamayacakt\u0131r.<\/p>\n<p>Bu kapsamda bulunup Kurumumuzda farkl\u0131 \u015fekilde i\u015flem g\u00f6ren i\u015fverenlerimizin, sigorta prim te\u015fvik, destek ile di\u011fer hak ve y\u00fck\u00fcml\u00fcl\u00fck bak\u0131m\u0131ndan ma\u011fduriyet ya\u015famamas\u0131 i\u00e7in Bakanl\u0131\u011f\u0131n ilgili talimat\u0131 uyar\u0131nca gerekli \u00f6nlemleri almalar\u0131 \u00f6nem arz etmektedir.<\/p>\n<p>4904 say\u0131l\u0131 Kanunun 17 nci maddesine g\u00f6re \u00f6zel istihdam b\u00fcrolar\u0131n\u0131n faaliyetlerine ve ge\u00e7ici i\u015f ili\u015fkisine y\u00f6nelik inceleme, denetim ve tefti\u015f Bakanl\u0131k i\u015f m\u00fcfetti\u015fleri taraf\u0131ndan yap\u0131lmaktad\u0131r.<\/p>\n<p>Bu bak\u0131mdan, \u00f6zel istihdam b\u00fcrosu ile hizmet ald\u0131klar\u0131 ki\u015filer aras\u0131nda kurulan ge\u00e7ici i\u015f ili\u015fkisinin 4857 say\u0131l\u0131 \u0130\u015f Kanunu ile 4904 say\u0131l\u0131 Kanunda yer alan d\u00fczenlemelere uygun kurulmad\u0131\u011f\u0131n\u0131n \u0130\u015f M\u00fcfetti\u015fleri taraf\u0131ndan 1\/11\/2023 tarihinden sonra d\u00fczenlenen raporlar ile ortaya konmas\u0131 ve s\u00f6z konusu raporlarda \u00f6zel istihdam b\u00fcrosu ve \u00f6zel istihdam b\u00fcrosu gibi hareket eden ger\u00e7ek ve t\u00fczel ki\u015filer taraf\u0131ndan bildirimi yap\u0131lan sigortal\u0131lar\u0131n bunlardan hizmet alan ger\u00e7ek ve t\u00fczel ki\u015filerin sigortal\u0131s\u0131 olarak say\u0131lmas\u0131 halinde; \u00e7al\u0131\u015fmalar\u0131n fiili olmas\u0131, Sosyal Sigorta \u0130\u015flemleri Y\u00f6netmeli\u011finin Ek-7 nci maddesinde belirtilen hal ve durumlara ili\u015fkin haks\u0131z menfaat tespit edilmemesi dolay\u0131s\u0131yla irat kaydedilecek bir durum olmamas\u0131 ve \u00e7al\u0131\u015fmalar\u0131 fiili oldu\u011fu tespit edilen sigortal\u0131lar\u0131n prime esas kazan\u00e7 ve g\u00fcnde de\u011fi\u015fiklik olmamas\u0131 kayd\u0131yla,<\/p>\n<p>\u2013 \u00d6zel istihdam b\u00fcrosu ve \u00f6zel istihdam b\u00fcrosu gibi hareket eden ger\u00e7ek ve t\u00fczel ki\u015fi i\u015fverenler taraf\u0131ndan yasal s\u00fcreler dahilinde yerine getirilen y\u00fck\u00fcml\u00fcl\u00fckler i\u00e7in sigortal\u0131lar\u0131n aktar\u0131ld\u0131\u011f\u0131 i\u015fyerine idari para cezas\u0131, gecikme cezas\u0131 ve gecikme zamm\u0131 uygulanmamas\u0131,<\/p>\n<p>\u2013 \u00d6zel istihdam b\u00fcrosu ve \u00f6zel istihdam b\u00fcrosu gibi hareket eden ger\u00e7ek ve t\u00fczel ki\u015fi i\u015fverenlere \u00f6denen hizmet bedeli ile hizmet sat\u0131n alan ger\u00e7ek ve t\u00fczel ki\u015filer taraf\u0131ndan dolayl\u0131 olarak sigorta primleri de \u00f6dendi\u011fi i\u00e7in sigortal\u0131 hizmetleri ile bu hizmetlere ili\u015fkin tahsilatlar\u0131n hizmet alan ger\u00e7ek ve t\u00fczel ki\u015filer ad\u0131na tescilli veya tescil edilecek i\u015fyerine aktar\u0131m\u0131n\u0131n yap\u0131lmas\u0131 ve aktar\u0131lan tahsilat tutarlar\u0131na ili\u015fkin olarak 5510 say\u0131l\u0131 Kanunun 89 uncu maddesi uyar\u0131nca prim iade i\u015fleminin yap\u0131lmamas\u0131,<\/p>\n<p>gerekmektedir.<\/p>\n<p><strong>\u00d6rnek 1<\/strong>\u2013 (A) \u00f6zel istihdam b\u00fcrosu ile (B) i\u015fvereni aras\u0131ndaki ge\u00e7ici i\u015f ili\u015fkisinin 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun \u201cGe\u00e7ici i\u015f ili\u015fkisi\u201d ba\u015fl\u0131kl\u0131 7 nci maddesi ile 4904 say\u0131l\u0131 Kanunda yer alan d\u00fczenlemelere uygun kurulmad\u0131\u011f\u0131n\u0131n \u0130\u015f M\u00fcfetti\u015fleri taraf\u0131ndan d\u00fczenlenen raporla ortaya konulmas\u0131 ve sigortal\u0131lar\u0131n (B) i\u015fvereninin sigortal\u0131lar\u0131 olmas\u0131 gerekti\u011fi y\u00f6n\u00fcnde bir h\u00fckm\u00fcn\/\u00f6nerinin belirtilmesi durumunda; sigortal\u0131lara dair y\u00fck\u00fcml\u00fcl\u00fckler (A) \u00f6zel istihdam b\u00fcrosu taraf\u0131ndan yasal s\u00fcreler dahilinde yerine getirilmesi halinde idari para cezas\u0131, gecikme cezas\u0131 ve gecikme zamm\u0131 uygulanmadan sigortal\u0131 hizmetleri ile varsa bu hizmetler kar\u015f\u0131l\u0131\u011f\u0131 yap\u0131lan tahsilatlar\u0131n (B) i\u015fverenine ait i\u015fyerine aktar\u0131lmas\u0131 gerekecektir.<\/p>\n<p>\u00d6zel istihdam b\u00fcrosu ve \u00f6zel istihdam b\u00fcrosu gibi hareket eden ger\u00e7ek ve t\u00fczel ki\u015fi i\u015fverene ait dosyaya hizmet aktar\u0131m\u0131 yap\u0131lan sigortal\u0131lar i\u00e7in olu\u015fan sigorta prim tahakkuklar\u0131n\u0131n bu hizmetler kar\u015f\u0131l\u0131\u011f\u0131 yap\u0131lan tahsilatlardan fazla olmas\u0131 veya i\u015fverene ait dosyaya hizmet aktar\u0131m\u0131 yap\u0131lan sigortal\u0131lar i\u00e7in ek ayl\u0131k prim ve hizmet belgesi\/muhtasar ve prim hizmet beyannamesi verilmesi gereken bir durumun ortaya \u00e7\u0131kmas\u0131 nedeniyle bor\u00e7 \u00e7\u0131kmas\u0131 hallerinde, yasal olarak \u00f6deme yap\u0131lmas\u0131 gereken son tarihten \u00f6demenin yap\u0131ld\u0131\u011f\u0131 tarihe kadar gecikme cezas\u0131 ve gecikme zamm\u0131 hesaplanacakt\u0131r.<\/p>\n<p>\u00d6zel istihdam b\u00fcrosu ve \u00f6zel istihdam b\u00fcrosu gibi hareket eden ger\u00e7ek ve t\u00fczel ki\u015filerden hizmet alanlara ait dosyaya hizmet aktar\u0131m\u0131 yap\u0131lan sigortal\u0131lar i\u00e7in bu \u015fekilde verilen ek ayl\u0131k prim ve hizmet belgesi\/muhtasar ve prim hizmet beyannamesi i\u00e7in idari para cezas\u0131 uygulanacakt\u0131r.<\/p>\n<p><strong>\u00d6rnek 2<\/strong>\u2013 \u00d6rnek1\u2019deki sigortal\u0131lar\u0131n ba\u015flang\u0131\u00e7tan beri \u00f6zel istihdam b\u00fcrosundan hizmet alan (B) i\u015fverenin sigortal\u0131s\u0131 say\u0131lmas\u0131 ve toplu i\u015f s\u00f6zle\u015fmesinde belirtilen haklardan faydalanmas\u0131n\u0131n gerekti\u011finin belirtilmesi nedeniyle olu\u015fan \u00fccret fark\u0131 i\u00e7in (B) i\u015fvereninden ek ayl\u0131k prim ve hizmet belgesi\/muhtasar ve prim hizmet beyannamesi istenildi\u011fi varsay\u0131ld\u0131\u011f\u0131nda, ek ayl\u0131k prim ve hizmet belgesinin\/muhtasar ve prim hizmet beyannamesinin verilmesinden kaynaklanan bor\u00e7 i\u00e7in yasal olarak \u00f6deme yap\u0131lmas\u0131 gereken son tarihten \u00f6demenin yap\u0131ld\u0131\u011f\u0131 tarihe kadar gecikme cezas\u0131 ve gecikme zamm\u0131 hesaplanacakt\u0131r.
