Ancak, bu s\u00fcre i\u015f\u00e7iye dinlenme zaman\u0131 olarak tan\u0131nmam\u0131\u015fsa, i\u015f\u00e7inin normal \u00fccretinin \u00f6denmesi gerekir. Ara dinlenmesinin kulland\u0131r\u0131lmas\u0131 zorunlu ise de, bunun kullan\u0131laca\u011f\u0131 zaman\u0131 belirlemek i\u015fverenin y\u00f6netim hakk\u0131yla ilgilidir. \u0130\u015f\u00e7ilerin tamam\u0131 ayn\u0131 anda ara dinlenme zaman\u0131n\u0131 kullan\u0131labilece\u011fi gibi, belli bir plan dahilinde s\u0131rayla kullanmalar\u0131 da m\u00fcmk\u00fcnd\u00fcr. Ancak ara dinlenme s\u00fcresinin, i\u015fe, ara dinlenme s\u00fcresi kadar ge\u00e7 ba\u015flama veya ayn\u0131 s\u00fcreyle erken b\u0131rakma \u015feklinde kulland\u0131r\u0131lmas\u0131 do\u011fru olmaz. Dava dosyas\u0131 i\u00e7in Tetkik Hakimi taraf\u0131ndan d\u00fczenlenen rapor dinlendikten sonra dosya incelendi, gere\u011fi konu\u015fulup d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p><strong>A) Davac\u0131 \u0130steminin \u00d6zeti:<\/strong><\/p>\n<p>Davac\u0131 vekili, m\u00fcvekkilinin daval\u0131 \u2026 Savunma ve G\u00fcvenlik Sistemleri Sanayi A.\u015e.\u2019ye ba\u011fl\u0131 olarak di\u011fer daval\u0131 \u2026\u015e.\u2019ne ait \u2026 \u015eubesinde silahl\u0131 \u00f6zel g\u00fcvenlik g\u00f6revlisi olarak 19.09.2005-30.11.2012 tarihleri aras\u0131nda kesintisiz \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131, m\u00fcvekkilinin haftada 5 g\u00fcn i\u015fyerinin a\u00e7\u0131ld\u0131\u011f\u0131 saatten kapan\u0131\u015fa kadar aral\u0131ks\u0131z \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131, tek g\u00fcvenlik g\u00f6revlisi olmas\u0131 sebebiyle kendisine ara dinlenme ve \u00f6\u011fle yeme\u011fi molas\u0131 kulland\u0131rmad\u0131\u011f\u0131n\u0131, i\u015fyerinin a\u00e7\u0131l\u0131\u015f ve kapan\u0131\u015f saatlerinin m\u00fcvekkilinin imzas\u0131n\u0131 ta\u015f\u0131yan tutanaklar ile sabit oldu\u011funu, m\u00fcvekkilinin 30.11.2012 tarihinde \u00fccretinin yasa ve s\u00f6zle\u015fmelere uygun olarak \u00f6denmemesi ve ara dinlenme ve di\u011fer haklar\u0131n\u0131n kulland\u0131r\u0131lmamas\u0131 nedeniyle i\u015f akdini hakl\u0131 nedenle feshetti\u011fini iddia ederek bir k\u0131s\u0131m i\u015f\u00e7ilik alacaklar\u0131n\u0131n daval\u0131lardan tahsiline karar verilmesini talep etmi\u015ftir.<\/p>\n<p><strong>B) Daval\u0131 Cevab\u0131n\u0131n \u00d6zeti:<\/strong><\/p>\n<p>Daval\u0131 \u2026 Savunma ve G\u00fcvenlik Sis. A.\u015e vekili ; davac\u0131n\u0131n 19.05.2005 y\u0131l\u0131ndan i\u015f akdinin feshedildi\u011fi tarihe kadar m\u00fcvekkil daval\u0131 \u015firket eleman\u0131 olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131, kabul anlam\u0131na gelmemekle birlikte davac\u0131n\u0131n talep etti\u011fi \u00fccret alacaklar\u0131n\u0131n zaman a\u015f\u0131m\u0131na u\u011frad\u0131\u011f\u0131n\u0131, m\u00fcvekkil daval\u0131n\u0131n T\u00fcrkiye genelinde hizmet veren, ihale usul\u00fcyle i\u015f alan kurumsal bir \u015firket oldu\u011funu, davac\u0131 iddialar\u0131n\u0131n ger\u00e7e\u011fe ayk\u0131r\u0131 olup maa\u015f \u00f6demelerinin eksiksiz olarak banka arac\u0131l\u0131\u011f\u0131 ile bordrolarda \u00f6dendi\u011fini, davac\u0131n\u0131n fazla mesai ve bayram mesaisi yapm\u0131\u015f ise buna ili\u015fkin \u00fccretlerin bordrolarda \u00f6dendi\u011fini, iddialar\u0131n\u0131n ger\u00e7e\u011fe ayk\u0131r\u0131 oldu\u011funu savunarak davan\u0131n reddine karar verilmesini talep etmi\u015ftir.<\/p>\n<p>Daval\u0131 \u2026vekili ; usuli itirazlar\u0131nda davac\u0131 ile m\u00fcvekkil daval\u0131 banka aras\u0131nda imzalanm\u0131\u015f hizmet s\u00f6zle\u015fmesi bulunmad\u0131\u011f\u0131n\u0131, davac\u0131n\u0131n di\u011fer daval\u0131n\u0131n \u00e7al\u0131\u015fan\u0131 oldu\u011funu, k\u0131dem ve fazla mesai talebinin m\u00fcvekkil daval\u0131 bankaya y\u00f6neltilmesinin haks\u0131z oldu\u011funu, davac\u0131n\u0131n di\u011fer daval\u0131 \u2026 Savunma ve G\u00fcvenlik Sistemleri San. Tic. A.\u015e. i\u015f\u00e7isi olarak m\u00fcvekkil daval\u0131 banka i\u015fyerinde \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131, davan\u0131n m\u00fcvekkil daval\u0131 banka y\u00f6n\u00fcnden husumet y\u00f6n\u00fcnden reddini talep ettiklerini, esas hakk\u0131ndaki beyanlar\u0131nda davac\u0131 ile di\u011fer daval\u0131 aras\u0131ndaki i\u015f s\u00f6zle\u015fmesi ve \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n kendileri taraf\u0131ndan ayr\u0131nt\u0131l\u0131 olarak bilinmedi\u011fini, davac\u0131n\u0131n m\u00fcvekkil daval\u0131 bankadan dava konusu tazminat ve alacak tutarlar\u0131n\u0131 talep etme hakk\u0131 bulunmad\u0131\u011f\u0131n\u0131 savunarak davan\u0131n reddine karar verilmesini talep etmi\u015ftir.<\/p>\n<p><strong>C) Yerel Mahkeme Karar\u0131n\u0131n \u00d6zeti:<\/strong><\/p>\n<p>Mahkemece, toplanan kan\u0131tlar ve al\u0131nan bilirki\u015fi raporuna g\u00f6re davan\u0131n k\u0131smen kabul\u00fcne karar verilmi\u015ftir.<\/p>\n<p><strong>D) Temyiz:<\/strong><\/p>\n<p>Karar\u0131 daval\u0131 banka ve daval\u0131 \u015firket vekili temyiz etmi\u015ftir.<\/p>\n<p><strong>E) Gerek\u00e7e:<\/strong><\/p>\n<p>1- Dosyadaki yaz\u0131lara toplanan delillerle karar\u0131n dayand\u0131\u011f\u0131 kanuni gerektirici sebeplere g\u00f6re, daval\u0131lar\u0131n a\u015fa\u011f\u0131daki bentlerin kapsam\u0131 d\u0131\u015f\u0131nda kalan temyiz itirazlar\u0131 yerinde de\u011fildir.<\/p>\n<p>2-\u0130\u015f\u00e7iye, i\u015fyerinde \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u0131rada fazla mesai yap\u0131p yapmad\u0131\u011f\u0131 ara dinlenmesi verilip verilmedi\u011fi ve s\u00fcresi konular\u0131nda taraflar aras\u0131nda uyu\u015fmazl\u0131k bulunmaktad\u0131r.<\/p>\n<p>\u0130\u015f\u00e7inin g\u00fcnl\u00fck i\u015f s\u00fcresi i\u00e7inde kesintisiz olarak hi\u00e7 ara vermeden \u00e7al\u0131\u015fmas\u0131 beklenemez. G\u00fcn i\u00e7inde i\u015f\u00e7inin yemek, \u00e7ay, sigara gibi ihtiya\u00e7lar sebebiyle ya da dinlenmek i\u00e7in belli bir zamana ihtiyac\u0131 vard\u0131r.<\/p>\n<p>Ara dinlenme <a href=\"https:\/\/www.alomaliye.com\/2003\/06\/10\/is-kanunu-4857-sayili-kanun\/\">4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun<\/a> 68 inci maddesinde d\u00fczenlenmi\u015ftir. An\u0131lan h\u00fck\u00fcmde ara dinlenme s\u00fcresi, g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresine g\u00f6re kademeli bir \u015fekilde belirlenmi\u015ftir. Buna g\u00f6re d\u00f6rt saat veya daha k\u0131sa s\u00fcreli g\u00fcnl\u00fck \u00e7al\u0131\u015fmalarda ara dinlenmesi en az onbe\u015f dakika, d\u00f6rt saatten fazla ve yedibu\u00e7uk saatten az \u00e7al\u0131\u015fmalar i\u00e7in en az yar\u0131m saat ve g\u00fcnl\u00fck yedibu\u00e7uk saati a\u015fan \u00e7al\u0131\u015fmalar bak\u0131m\u0131ndan ise en az bir saat ara dinlenmesi verilmelidir. Uygulamada yedibu\u00e7uk saatlik \u00e7al\u0131\u015fma s\u00fcresinin \u00e7ok fazla a\u015f\u0131ld\u0131\u011f\u0131 g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcrelerine de rastlan\u0131lmaktad\u0131r. \u0130\u015f Kanunu\u2019nun 63 \u00fcnc\u00fc maddesi h\u00fckm\u00fcne g\u00f6re, g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresi onbir saati a\u015famayaca\u011f\u0131ndan, 68 inci maddenin belirledi\u011fi yedibu\u00e7uk saati a\u015fan \u00e7al\u0131\u015fmalar y\u00f6n\u00fcnden en az bir saatlik ara dinlenmesi s\u00fcresinin, g\u00fcnl\u00fck en \u00e7ok onbir saate kadar olan \u00e7al\u0131\u015fmalarla ilgili oldu\u011fu kabul edilmelidir. Ba\u015fka bir anlat\u0131mla g\u00fcnde onbir saate kadar olan (on bir saat dahil) \u00e7al\u0131\u015fmalar i\u00e7in ara dinlenmesi en az bir saat, onbir saatten fazla \u00e7al\u0131\u015fmalarda ise en az birbu\u00e7uk saat olarak verilmelidir.<\/p>\n<p>\u0130\u015f\u00e7i, ara dinlenme saatinde tamamen serbesttir. Bu s\u00fcreyi i\u015fyeri i\u00e7inde ya da d\u0131\u015f\u0131nda ge\u00e7irebilir. \u0130\u015fyerinde ge\u00e7irmesi ve bu s\u00fcre i\u00e7inde \u00e7al\u0131\u015fmaya devam etmesi durumunda ara dinlenmesi verilmemi\u015f say\u0131l\u0131r. Ancak i\u015f\u00e7i i\u015fyerinde kalsa bile, ara dinlenmesi s\u00fcresini serbest\u00e7e kullanabilir, bu s\u00fcre i\u00e7inde \u00e7al\u0131\u015fmaya zorlanamaz.<\/p>\n<p>Ara dinlenmesi i\u00e7in \u00fccret \u00f6denmesi gerekmez. Ancak, bu s\u00fcre i\u015f\u00e7iye dinlenme zaman\u0131 olarak tan\u0131nmam\u0131\u015fsa, i\u015f\u00e7inin normal \u00fccretinin \u00f6denmesi gerekir. Bu s\u00fcrenin haftal\u0131k 45 saati a\u015fan k\u0131sm\u0131n\u0131 olu\u015fturmas\u0131 halinde ise, zaml\u0131 \u00fccret \u00f6denmelidir.<\/p>\n<p>Ara dinlenme s\u00fcreleri kural olarak aral\u0131ks\u0131z olarak kulland\u0131r\u0131l\u0131r. Ara dinlenmesinin kulland\u0131r\u0131lmas\u0131 zorunlu ise de, bunun kullan\u0131laca\u011f\u0131 zaman\u0131 belirlemek i\u015fverenin y\u00f6netim hakk\u0131yla ilgilidir. \u0130\u015f\u00e7ilerin tamam\u0131 ayn\u0131 anda ara dinlenme zaman\u0131n\u0131 kullan\u0131labilece\u011fi gibi, belli bir plan dahilinde s\u0131rayla kullanmalar\u0131 da m\u00fcmk\u00fcnd\u00fcr. Ancak ara dinlenme s\u00fcresinin, i\u015fe, ara dinlenme s\u00fcresi kadar ge\u00e7 ba\u015flama veya ayn\u0131 s\u00fcreyle erken b\u0131rakma \u015feklinde kulland\u0131r\u0131lmas\u0131 do\u011fru olmaz. Ara dinlenme s\u00fcresinin g\u00fcnl\u00fck \u00e7al\u0131\u015fma i\u00e7inde belli bir zamanda amaca uygun \u015fekilde kulland\u0131r\u0131lmas\u0131 gerekir (Yarg\u0131tay 9.HD. 17.11.2008 g\u00fcn 2007\/35281 E, 2008\/30985 K.).<\/p>\n<p><a href=\"https:\/\/www.alomaliye.com\/2004\/04\/06\/is-kanununa-iliskin-calisma-sureleri-yonetmeligi\/\">\u0130\u015f Kanununa \u0130li\u015fkin \u00c7al\u0131\u015fma S\u00fcreleri Y\u00f6netmeli\u011fi\u2019nin<\/a> 3 \u00fcnc\u00fc maddesinin ikinci f\u0131kras\u0131nda, ara dinlenmelerinin iklim, mevsim, y\u00f6redeki gelenekler ve i\u015fin niteli\u011fine g\u00f6re yirmid\u00f6rt saat i\u00e7inde kesintisiz oniki saat dinlenme s\u00fcresi dikkate al\u0131narak verilece\u011fi h\u00fckme ba\u011flanm\u0131\u015ft\u0131r. De\u011finilen maddenin birinci f\u0131kras\u0131nda ise, ara dinlenme s\u00fcresinin \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lmayaca\u011f\u0131 a\u00e7\u0131klanm\u0131\u015ft\u0131r.<\/p>\n<p>Somut uyu\u015fmazl\u0131kta; Mahkemece fazla mesai hesab\u0131 yap\u0131l\u0131rken \u0130\u015f Kanunu\u2019nun 68. maddesi uyar\u0131nca 12 saatlik \u00e7al\u0131\u015fma i\u00e7in 1,5 saat olarak d\u00fc\u015f\u00fclmesi gereken ara dinlenmenin gerek\u00e7esi de a\u00e7\u0131klanmadan 1 saat olarak d\u00fc\u015f\u00fclmesi hatal\u0131d\u0131r.<\/p>\n<p><strong>F) Sonu\u00e7:<\/strong><\/p>\n<p>Temyiz olunan karar\u0131n, yukar\u0131da yaz\u0131l\u0131 sebepten dolay\u0131 BOZULMASINA, pe\u015fin al\u0131nan temyiz harc\u0131n\u0131n istek halinde ilgiliye iadesine 24\/09\/2019 tarihinde oybirli\u011fi ile karar verildi.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00d6ZET: \u0130\u015f\u00e7i, ara dinlenme saatinde tamamen serbesttir.
