Eri\u015fkinler \u0130\u00e7in Engellilik Sa\u011fl\u0131k Kurulu Raporuna g\u00f6re en az % 40 oran\u0131nda zihinsel veya ruhsal engelli olan veya \u00c7ocuklar \u0130\u00e7in \u00d6zel Gereksinim Raporuna g\u00f6re en az \u201chafif d\u00fczeyde \u00f6zel gereksinimi vard\u0131r (%40-49)\u201d ibaresi bulunan zihinsel veya ruhsal engelli bireyi,<\/p>\n<p>e) \u0130\u015fveren: Sahip oldu\u011fu i\u015fyeri i\u00e7in korumal\u0131 i\u015fyeri stat\u00fcs\u00fc almak \u00fczere ba\u015fvuruda bulunan ger\u00e7ek veya t\u00fczel ki\u015fiyi,<\/p>\n<p>f) Komisyon: \u0130llerde Valilik b\u00fcnyesinde, Aile ve Sosyal Hizmetler \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc, \u00c7al\u0131\u015fma ve \u0130\u015f Kurumu \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc, \u0130l Milli E\u011fitim M\u00fcd\u00fcrl\u00fc\u011f\u00fc, \u0130l Sa\u011fl\u0131k M\u00fcd\u00fcrl\u00fc\u011f\u00fc ve gerekli hallerde Valilik\u00e7e g\u00f6revlendirilen di\u011fer kamu kurum ve kurulu\u015flar\u0131 temsilcilerinden olu\u015fan, sekretaryas\u0131 Aile ve Sosyal Hizmetler \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan y\u00fcr\u00fct\u00fclen ve \u00e7al\u0131\u015fma usul ve esaslar\u0131 Engelli ve Ya\u015fl\u0131 Hizmetleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan belirlenecek olan komisyonu,<\/p>\n<p>g) Korumal\u0131 i\u015f merkezi: Bir yap\u0131 veya alan b\u00fct\u00fcnl\u00fc\u011f\u00fc olan, i\u00e7inde birden fazla korumal\u0131 i\u015fyeri bulunan; beslenme, giyinme, e\u011flenme, dinlenme, k\u00fclt\u00fcrel ve benzeri ihtiya\u00e7lar\u0131n bir k\u0131sm\u0131n\u0131n veya tamam\u0131n\u0131n kar\u015f\u0131land\u0131\u011f\u0131 ortak kullan\u0131m alanlar\u0131n\u0131 i\u00e7eren merkez\u00ee bir y\u00f6netim taraf\u0131ndan y\u00f6netilen i\u015fletmeyi,<\/p>\n<p>\u011f) Korumal\u0131 i\u015fyeri: \u0130\u015f g\u00fcc\u00fc piyasas\u0131na kazand\u0131r\u0131lmalar\u0131 g\u00fc\u00e7 olan zihinsel veya ruhsal engelli bireylere istihdam olu\u015fturmak amac\u0131yla Devlet taraf\u0131ndan teknik ve mali y\u00f6nden desteklenen ve \u00e7al\u0131\u015fma ortam\u0131 \u00f6zel olarak d\u00fczenlenen i\u015fyerini,<\/p>\n<p>h) Korumal\u0131 i\u015fyeri y\u00f6neticisi: Korumal\u0131 i\u015fyerinin i\u015fleyi\u015finden sorumlu olan ki\u015fiyi,<\/p>\n<p>\u0131) Merkezi y\u00f6netim: Korumal\u0131 i\u015f merkezinin maliki veya temsilcisi taraf\u0131ndan yetkilendirilen ger\u00e7ek veya t\u00fczel ki\u015filerden olu\u015fan y\u00f6netimi,<\/p>\n<p>i) Merkezi y\u00f6netim odas\u0131: Korumal\u0131 i\u015fyerlerinin ba\u011fl\u0131 oldu\u011fu korumal\u0131 i\u015f merkezinin sahibi veya y\u00f6netiminden sorumlu ki\u015filerin kullanaca\u011f\u0131 b\u00f6l\u00fcm\u00fc,<\/p>\n<p>j) Mutfak ve yemekhane: Korumal\u0131 i\u015f merkezinde \u00e7al\u0131\u015fanlar\u0131n yemek ihtiya\u00e7lar\u0131n\u0131n kar\u015f\u0131lanaca\u011f\u0131 b\u00f6l\u00fcm\u00fc,<\/p>\n<p>k) Sa\u011fl\u0131k odas\u0131 veya kabini: Korumal\u0131 i\u015f merkezinde tam zamanl\u0131 veya yar\u0131 zamanl\u0131 sa\u011fl\u0131k personeli taraf\u0131ndan ilk yard\u0131m ve ilk m\u00fcdahalenin yap\u0131ld\u0131\u011f\u0131 ve engellilerin kulland\u0131\u011f\u0131 ila\u00e7 ve sa\u011fl\u0131k malzemelerinin bulundu\u011fu b\u00f6l\u00fcm\u00fc,<\/p>\n<p>l) Sosyal servis: Say\u0131s\u0131 10 ve \u00fczeri olan korumal\u0131 i\u015fyerlerinin olu\u015fturdu\u011fu korumal\u0131 i\u015f merkezlerinde \u00fcniversitelerin sosyal hizmet, psikoloji, psikolojik dan\u0131\u015fmanl\u0131k ve rehberlik ve \u00f6zel e\u011fitim alanlar\u0131nda en az lisans e\u011fitimi alm\u0131\u015f meslek elemanlar\u0131 taraf\u0131ndan; i\u015fyerinde \u00e7al\u0131\u015fmaya ba\u015flayan bireylerin kabul, ayr\u0131l\u0131\u015f, ayr\u0131l\u0131\u015f sonras\u0131 dan\u0131\u015fmanl\u0131k hizmetlerinin verilmesi, engelli ve ailelerine gerekli rehberlik hizmetlerinin sunulmas\u0131, sosyal ve k\u00fclt\u00fcrel faaliyetlerin d\u00fczenlenmesi, toplumsal sorumluluk \u00e7er\u00e7evesinde merkezde verilen hizmetlere halk\u0131n g\u00f6n\u00fcll\u00fc katk\u0131 ve kat\u0131l\u0131m\u0131n\u0131 sa\u011flay\u0131c\u0131 etkinlik programlar\u0131n\u0131n d\u00fczenlenmesi, merkezi y\u00f6netim sekretaryas\u0131n\u0131n y\u00fcr\u00fct\u00fclmesi ve Aile ve Sosyal Hizmetler \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fcne g\u00f6nderilecek t\u00fcm bilgi, belge, form ve yaz\u0131\u015fmalar\u0131n yap\u0131lmas\u0131 ve\/veya koordine edilmesi \u00e7al\u0131\u015fmalar\u0131n\u0131n y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fc b\u00f6l\u00fcm\u00fc,<\/p>\n<p>m) Personel veya i\u015f\u00e7i odas\u0131: Korumal\u0131 i\u015f merkezinde \u00e7al\u0131\u015fan engelli personel ile i\u015f yerinde bulunan di\u011fer \u00e7al\u0131\u015fanlar\u0131n giyinme, soyunma ve dinlenme gibi ihtiya\u00e7lar\u0131n\u0131 kar\u015f\u0131lad\u0131klar\u0131 oday\u0131,<\/p>\n<p>ifade\u00a0eder.<\/p>\n<p><strong>\u0130K\u0130NC\u0130 B\u00d6L\u00dcM<\/strong><\/p>\n<p><strong>Korumal\u0131 \u0130\u015fyeri Stat\u00fcs\u00fcn\u00fcn Kazan\u0131lmas\u0131<\/strong><\/p>\n<p><strong>Korumal\u0131 i\u015fyeri stat\u00fcs\u00fc i\u00e7in ba\u015fvuruda bulunma<\/strong><\/p>\n<p><strong>MADDE 4 \u2013<\/strong>\u00a0(1) 14 \u00fcnc\u00fc maddenin birinci f\u0131kras\u0131nda belirtilen nitelikleri haiz engelli en az be\u015f bireyin \u00e7al\u0131\u015ft\u0131\u011f\u0131 veya \u00e7al\u0131\u015faca\u011f\u0131 i\u015fyerinin i\u015fvereni, korumal\u0131 i\u015fyeri stat\u00fcs\u00fcn\u00fcn kazan\u0131lmas\u0131 i\u00e7in Aile ve Sosyal Hizmetler \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fcne ba\u015fvuruda bulunur. Korumal\u0131 i\u015fyerlerinde \u00e7al\u0131\u015facak engelli bireylerin say\u0131s\u0131n\u0131n korumal\u0131 i\u015fyerindeki toplam i\u015f\u00e7i say\u0131s\u0131na oran\u0131 y\u00fczde elliden az olamaz. Bu kapsamda \u00e7al\u0131\u015ft\u0131r\u0131lacak i\u015f\u00e7i say\u0131s\u0131n\u0131n tespitinde, belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmesine ve belirli s\u00fcreli i\u015f s\u00f6zle\u015fmesine g\u00f6re \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7iler esas al\u0131n\u0131r. K\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesine g\u00f6re \u00e7al\u0131\u015fanlar, \u00e7al\u0131\u015fma s\u00fcreleri dikkate al\u0131narak tam s\u00fcreli \u00e7al\u0131\u015fmaya d\u00f6n\u00fc\u015ft\u00fcr\u00fcl\u00fcr.<\/p>\n<p>(2) Oranlar\u0131n hesaplanmas\u0131nda yar\u0131ma kadar kesirler dikkate al\u0131nmaz, yar\u0131m ve daha fazla olanlar tama d\u00f6n\u00fc\u015ft\u00fcr\u00fcl\u00fcr.<\/p>\n<p><strong>Ba\u015fvuruda i\u015fverenden istenecek belgeler<\/strong><\/p>\n<p><strong>MADDE 5 \u2013<\/strong>\u00a0(1) Ger\u00e7ek veya t\u00fczel ki\u015filer, i\u015fyerinin \u00fcretim faaliyetini veya faaliyetlerini, i\u015fyerinde \u00e7al\u0131\u015fan veya \u00e7al\u0131\u015facak toplam i\u015f\u00e7i say\u0131s\u0131n\u0131, \u00e7al\u0131\u015fan veya \u00e7al\u0131\u015facak engelli birey say\u0131s\u0131n\u0131, engel durumlar\u0131n\u0131 ve i\u015fyerinde yapt\u0131\u011f\u0131 veya yapaca\u011f\u0131 i\u015fler ile i\u015fyerinin adresini belirten ve i\u015fyerine korumal\u0131 i\u015fyeri stat\u00fcs\u00fc kazand\u0131rma talebini i\u00e7eren dilek\u00e7e ile bu maddenin ikinci f\u0131kras\u0131 ve 6\u00a0nc\u0131\u00a0maddede belirtilen belgelerle birlikte Aile ve Sosyal Hizmetler \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fcne ba\u015fvururlar.<\/p>\n<p>(2) Korumal\u0131 i\u015fyeri a\u00e7mak isteyen ger\u00e7ek ki\u015fiden veya t\u00fczel ki\u015fi temsilcisinden;<\/p>\n<p>a) T.C. Kimlik numaras\u0131 beyan\u0131,<\/p>\n<p>b) Adli sicil kayd\u0131na ili\u015fkin yaz\u0131l\u0131 beyan\u0131,<\/p>\n<p>c) T\u00fczel ki\u015finin temsilcisinin yetki belgesi,<\/p>\n<p>\u00e7) Dernek ve vak\u0131flar i\u00e7in, vak\u0131f senedi veya dernek t\u00fcz\u00fc\u011f\u00fcnde ama\u00e7lar aras\u0131nda e\u011fitim ve \u00fcretim faaliyetlerinin yer ald\u0131\u011f\u0131n\u0131 g\u00f6steren belge,<\/p>\n<p>d)\u00a021\/7\/1953tarihli ve\u00a0<strong><a href=\"https:\/\/www.alomaliye.com\/2015\/01\/02\/amme-alacaklarinin-tahsil-usulu-hakkinda-kanun-aatuhk-6183-sayili-kanun\/\">6183 say\u0131l\u0131 Amme Alacaklar\u0131n\u0131n Tahsil Usul\u00fc Hakk\u0131nda Kanunun<\/a><\/strong>\u00a022\/A maddesi h\u00fckm\u00fcne g\u00f6re vadesi ge\u00e7mi\u015f bor\u00e7 olarak kabul edilen vergi t\u00fcrlerinden borcunun olmad\u0131\u011f\u0131na dair belge ile sosyal g\u00fcvenlik kurumlar\u0131ndan al\u0131nacak prim borcu olmad\u0131\u011f\u0131na dair belge,<\/p>\n<p>e) \u0130lgili mevzuat\u0131 uyar\u0131nca al\u0131nmas\u0131 gereken izin ve belgeler,<\/p>\n<p>istenir.<\/p>\n<p><strong>Korumal\u0131 i\u015fyeri y\u00f6neticisinden istenecek belgeler<\/strong><\/p>\n<p><strong>MADDE 6 \u2013<\/strong>\u00a0(1) Korumal\u0131 i\u015fyeri y\u00f6neticisinden;<\/p>\n<p>a) T.C. Kimlik numaras\u0131 beyan\u0131,<\/p>\n<p>b) Adli sicil kayd\u0131na ili\u015fkin yaz\u0131l\u0131 beyan\u0131,<\/p>\n<p>c) Bula\u015f\u0131c\u0131 bir hastal\u0131\u011f\u0131 bulunmad\u0131\u011f\u0131na ili\u015fkin sa\u011fl\u0131k raporu,<\/p>\n<p>\u00e7) E\u011fitim durumuna ili\u015fkin yaz\u0131l\u0131 beyan\u0131,<\/p>\n<p>istenir.<\/p>\n<p><strong>Taleplerin komisyonca de\u011ferlendirilmesi ve korumal\u0131 i\u015fyeri stat\u00fcs\u00fc belgesinin d\u00fczenlenmesi<\/strong><\/p>\n<p><strong>MADDE 7 \u2013<\/strong>\u00a0(1) Korumal\u0131 i\u015fyeri stat\u00fcs\u00fc almak \u00fczere Aile ve Sosyal Hizmetler \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fcne ba\u015fvuran ger\u00e7ek veya t\u00fczel ki\u015filerin talepleri i\u015fyerinde gerekli tespit ve incelemeleri yapmak suretiyle en ge\u00e7 otuz g\u00fcn i\u00e7inde Komisyonca de\u011ferlendirilir. Ba\u015fvurusu yap\u0131lanlardan Komisyonca yap\u0131lacak de\u011ferlendirme sonucunda uygun g\u00f6r\u00fclen i\u015fyerlerine Valilik\u00e7e, Korumal\u0131 \u0130\u015fyeri Stat\u00fcs\u00fc Belgesi d\u00fczenlenir.<\/p>\n<p><strong>\u00dc\u00c7\u00dcNC\u00dc B\u00d6L\u00dcM<\/strong><\/p>\n<p><strong>Korumal\u0131 \u0130\u015fyerinde \u00c7al\u0131\u015ft\u0131r\u0131lacak Personelin Nitelikleri<\/strong><\/p>\n<p><strong>Korumal\u0131 i\u015fyerinde \u00e7al\u0131\u015ft\u0131r\u0131lacak personel<\/strong><\/p>\n<p><strong>MADDE 8 \u2013<\/strong>\u00a0(1) Korumal\u0131 i\u015fyerinde; i\u015fyeri y\u00f6neticisi ile mesleki ve teknik e\u011fitim alan\u0131nda y\u00fcksek\u00f6\u011frenim g\u00f6rm\u00fc\u015f veya usta \u00f6\u011freticilik yeterli\u011fini haiz e\u011fitici personel istihdam\u0131 zorunludur.<\/p>\n<p>(2) \u0130\u015fyeri y\u00f6neticisi, birden fazla korumal\u0131 i\u015fyerinin y\u00f6neticisi olamaz. Ancak, nitelikleri haiz olmak kayd\u0131yla, ayn\u0131 i\u015f yerinde e\u011fitici personel g\u00f6revini y\u00fcr\u00fctebilir.<\/p>\n<p>(3) Korumal\u0131 i\u015fyerinde, i\u015fyerinin kapasitesine g\u00f6re ayr\u0131ca teknik, idari ve yard\u0131mc\u0131 personel ile ihtiya\u00e7 duyulabilecek di\u011fer personel \u00e7al\u0131\u015ft\u0131r\u0131labilir.<\/p>\n<p><strong>Personel deste\u011fi<\/strong><\/p>\n<p><strong>MADDE 9 \u2013\u00a0<\/strong>(1) Korumal\u0131 i\u015fyerlerine Komisyon taraf\u0131ndan gerekli g\u00f6r\u00fclmesi halinde Valilik\u00e7e ilgili il m\u00fcd\u00fcrl\u00fcklerinden g\u00f6revlendirme yoluyla uzman personel deste\u011fi sa\u011flanabilir.<\/p>\n<p><strong>D\u00d6RD\u00dcNC\u00dc B\u00d6L\u00dcM<\/strong><\/p>\n<p><strong>Fiziksel Ko\u015fullar ve Donan\u0131m<\/strong><\/p>\n<p><strong>Emniyet ve trafik g\u00fcvenli\u011fi<\/strong><\/p>\n<p><strong>MADDE 10 \u2013<\/strong>\u00a0(1) Korumal\u0131 i\u015fyeri veya korumal\u0131 i\u015f merkezi binas\u0131n\u0131n bulundu\u011fu yerin, engelli bireylerin geli\u015f ve gidi\u015flerinde trafik y\u00f6n\u00fcnden uygun ve emniyetli olmas\u0131 \u015fart\u0131 aran\u0131r.<\/p>\n<p><strong>Yang\u0131ndan korunma ve elektrik tertibat\u0131<\/strong><\/p>\n<p><strong>MADDE 11 \u2013<\/strong>\u00a0(1) Korumal\u0131 i\u015fyeri veya korumal\u0131 i\u015f merkezinde yang\u0131ndan korunma i\u00e7in yeterli say\u0131da yang\u0131n s\u00f6nd\u00fcrme cihaz\u0131 ve malzemesi, sesli ve \u0131\u015f\u0131kl\u0131 alarm sistemi ile engelli bireylerin kullan\u0131m\u0131na uygun yang\u0131n tahliye sistemi bulundurulmas\u0131 zorunludur.<\/p>\n<p>(2) Korumal\u0131 i\u015fyeri veya korumal\u0131 i\u015f merkezinde elektrik anahtar\u0131, priz, lamba gibi elektrikli aletler, kesici delici aletler ile yan\u0131c\u0131 ve yak\u0131c\u0131 maddelerin engelli bireyler i\u00e7in tehlike olu\u015fturmas\u0131n\u0131 \u00f6nleyecek tedbirler al\u0131n\u0131r.<\/p>\n<p>(3) Korumal\u0131 i\u015fyeri veya korumal\u0131 i\u015f merkezi binas\u0131 \u00e7evresinde patlay\u0131c\u0131 ve yan\u0131c\u0131 madde satan veya depolayan kurulu\u015flar bulunmas\u0131 h\u00e2linde,\u00a027\/11\/2007\u00a0tarihli ve 2007\/12937 say\u0131l\u0131 Bakanlar Kurulu Karar\u0131 ile y\u00fcr\u00fcrl\u00fc\u011fe konulan\u00a0<strong><a href=\"https:\/\/www.alomaliye.com\/2007\/12\/19\/binalarin-yangindan-korunmasi\/\">Binalar\u0131n Yang\u0131ndan Korunmas\u0131 Hakk\u0131nda Y\u00f6netmelik<\/a><\/strong>\u00a0h\u00fck\u00fcmlerine uygun mesafelerin korunmas\u0131 ve tedbirlerin al\u0131nmas\u0131 sa\u011flan\u0131r.<\/p>\n<p><strong>Korumal\u0131 i\u015fyerinin fiziksel ko\u015fullar\u0131<\/strong><\/p>\n<p><strong>MADDE 12 \u2013<\/strong>\u00a0(1) Korumal\u0131 i\u015fyeri veya korumal\u0131 i\u015f merkezinin fiziksel ko\u015fullar\u0131 a\u015fa\u011f\u0131daki \u00f6zellikleri ta\u015f\u0131mal\u0131d\u0131r:<\/p>\n<p>a) T\u00fcrk Standartlar\u0131 Enstit\u00fcs\u00fc taraf\u0131ndan i\u015fyerleri i\u00e7in belirlenen fiziksel standartlar, korumal\u0131 i\u015fyerlerinde de ge\u00e7erlidir. Korumal\u0131 i\u015fyerinin m\u00fcstakil bir binada olmas\u0131 tercih nedenidir. Korumal\u0131 i\u015fyerinde \u00e7al\u0131\u015fan zihinsel ve ruhsal engelli bireylerin hareket k\u0131s\u0131tl\u0131l\u0131\u011f\u0131n\u0131n bulunmamas\u0131 durumunda; m\u00fcstakil villa tipi,\u00a0dubleks, tripleks binalarda hizmet vermesi halinde asans\u00f6r \u015fart\u0131 aranmaz. \u00dc\u00e7 ve \u00fczeri katl\u0131 di\u011fer binalarda ve hareket k\u0131s\u0131tl\u0131l\u0131\u011f\u0131 olan zihinsel veya ruhsal engelli bireylerin \u00e7al\u0131\u015ft\u0131\u011f\u0131 korumal\u0131 i\u015fyerinin zemin \u00fcst\u00fc katlarda hizmet vermesi durumunda yang\u0131n merdiveni ve eri\u015filebilirlik standartlar\u0131na uygun asans\u00f6r bulunmas\u0131 zorunludur.<\/p>\n<p>b) Korumal\u0131 i\u015fyeri rutubetli ortamda olmamal\u0131, g\u00fcn \u0131\u015f\u0131\u011f\u0131 almal\u0131 ve uygun elektrik \u0131\u015f\u0131\u011f\u0131 ile ayd\u0131nlat\u0131lmal\u0131d\u0131r.<\/p>\n<p>c) Korumal\u0131 i\u015fyeri taban\u0131 sa\u011fl\u0131\u011fa zarar vermeyecek, \u0131slak ve kuru halde kaymayan ve kolay temizlenen bir malzeme ile kaplanmal\u0131d\u0131r.<\/p>\n<p>\u00e7) Merdivenlerin geni\u015fli\u011fi ve y\u00fcksekli\u011fi ini\u015f ve \u00e7\u0131k\u0131\u015flarda kolayl\u0131k sa\u011flayacak \u015fekilde eri\u015filebilirlik standartlar\u0131na uygun olmal\u0131, emniyet korkuluklar\u0131 bulunmal\u0131d\u0131r.<\/p>\n<p>d) Kap\u0131lar eri\u015filebilirlik standartlar\u0131na uygun olmal\u0131d\u0131r.<\/p>\n<p>e) At\u00f6lyeler ve di\u011fer b\u00f6l\u00fcmlerin aras\u0131 duvarla b\u00f6l\u00fcnmeli, sesli makinelerin kullan\u0131ld\u0131\u011f\u0131 yerlerde ses ge\u00e7irmez materyaller tercih edilmelidir.<\/p>\n<p>f) Korumal\u0131 i\u015fyerinin ve korumal\u0131 i\u015f merkezlerinin tuvaletleri ve du\u015f alanlar\u0131 eri\u015filebilirlik standartlar\u0131na uygun olmal\u0131d\u0131r.<\/p>\n<p>g) Korumal\u0131 i\u015f merkezinde; merkezi y\u00f6netim odas\u0131, sosyal servis, personel ve i\u015f\u00e7i odas\u0131, at\u00f6lye, \u00e7ok ama\u00e7l\u0131 salon, mutfak ve yemekhane, sa\u011fl\u0131k odas\u0131 veya kabini, banyo ve tuvalet ile ihtiya\u00e7 duyulan di\u011fer b\u00f6l\u00fcmlerin bulundurulmas\u0131 zorunludur.<\/p>\n<p><strong>BE\u015e\u0130NC\u0130 B\u00d6L\u00dcM<\/strong><\/p>\n<p><strong>Korumal\u0131 \u0130\u015fyerinin \u0130\u015fleyi\u015fine \u0130li\u015fkin Esaslar<\/strong><\/p>\n<p><strong>Korumal\u0131 i\u015fyerine engelli bireylerin kabul\u00fc<\/strong><\/p>\n<p><strong>MADDE 13 \u2013<\/strong>\u00a0(1) T\u00fcrkiye \u0130\u015f Kurumuna kay\u0131tl\u0131 ve korumal\u0131 i\u015fyerinde \u00e7al\u0131\u015fmak isteyen engelli bireyler bireysel olarak veya \u00c7al\u0131\u015fma ve \u0130\u015f Kurumu \u0130l M\u00fcd\u00fcrl\u00fckleri arac\u0131l\u0131\u011f\u0131 ile i\u015fyerlerine ba\u015fvururlar. \u0130\u015fyeri, i\u015fe ald\u0131\u011f\u0131 engelli bireyleri en ge\u00e7 bir ay i\u00e7inde \u00c7al\u0131\u015fma ve \u0130\u015f Kurumu \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc ve Aile ve Sosyal Hizmetler \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fcne bildirmekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p><strong>Korumal\u0131 i\u015fyerine kabul edilecek engelli bireyler ve istenecek belgeler<\/strong><\/p>\n<p><strong>MADDE 14 \u2013<\/strong>\u00a0(1) Korumal\u0131 i\u015fyerinde istihdam edilebilmek i\u00e7in;<\/p>\n<p>a) Eri\u015fkinler \u0130\u00e7in Engellilik Sa\u011fl\u0131k Kurulu Raporuna g\u00f6re en az % 40 oran\u0131nda zihinsel veya ruhsal engelli olmak veya \u00c7ocuklar \u0130\u00e7in \u00d6zel Gereksinim Raporuna g\u00f6re en az \u201chafif d\u00fczeyde \u00f6zel gereksinimi vard\u0131r (%40-49)\u201d ibaresi bulunan zihinsel veya ruhsal engelli birey olmak,<\/p>\n<p>b) T\u00fcrkiye \u0130\u015f Kurumuna kay\u0131tl\u0131 olmak,<\/p>\n<p>c) 15 ya\u015f\u0131n\u0131 bitirmi\u015f olmak,<\/p>\n<p>gerekir.<\/p>\n<p>(2) Kabulde;<\/p>\n<p>a) T.C. Kimlik Numaras\u0131 beyan\u0131,<\/p>\n<p>b) Eri\u015fkinler \u0130\u00e7in Engellilik Sa\u011fl\u0131k Kurulu Raporunun veya \u00c7ocuklar \u0130\u00e7in \u00d6zel Gereksinim Raporunun asl\u0131 veya onayl\u0131 \u00f6rne\u011fi,<\/p>\n<p>c) \u0130ki adet foto\u011fraf,<\/p>\n<p>\u00e7) Var ise \u00f6\u011frenim belgesinin veya \u00e7\u0131k\u0131\u015f belgesinin asl\u0131 veya asl\u0131 ibraz edildi\u011finde Aile ve Sosyal Hizmetler \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fcnce onaylanan \u00f6rne\u011fi,<\/p>\n<p>istenir.<\/p>\n<p><strong>Korumal\u0131 i\u015fyerinde \u00e7al\u0131\u015fan engelli bireyin i\u015ften ayr\u0131lmas\u0131<\/strong><\/p>\n<p><strong>MADDE 15 \u2013\u00a0<\/strong>(1) Korumal\u0131 i\u015fyerleri, ayl\u0131k personel durum \u00e7izelgesini takip eden ay\u0131n yedinci g\u00fcn\u00fcne kadar d\u00fczenleyerek Aile ve Sosyal Hizmetler \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fcne g\u00f6nderir. Ay\u0131n yedinci g\u00fcn\u00fcn\u00fcn tatile denk gelmesi halinde takip eden ilk i\u015f g\u00fcn\u00fc g\u00f6nderilir. \u0130\u015fyeri, herhangi bir sebeple i\u015f s\u00f6zle\u015fmesi sona eren engelli bireyin ayr\u0131l\u0131\u015f nedenlerini yedi g\u00fcn i\u00e7inde Aile ve Sosyal Hizmetler \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fcne bildirmekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p><strong>ALTINCI B\u00d6L\u00dcM<\/strong><\/p>\n<p><strong>\u00c7e\u015fitli ve Son H\u00fck\u00fcmler<\/strong><\/p>\n<p><strong>Denetim<\/strong><\/p>\n<p><strong>MADDE 16 \u2013<\/strong>\u00a0(1) Korumal\u0131 i\u015fyerleri, bu Y\u00f6netmelikte belirlenen hususlarla s\u0131n\u0131rl\u0131 olmak ve di\u011fer mevzuat\u0131n denetime ili\u015fkin h\u00fck\u00fcmleri sakl\u0131 kalmak kayd\u0131yla, y\u0131lda en az bir kez Aile ve Sosyal Hizmetler \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan, gerekli g\u00f6r\u00fcld\u00fc\u011f\u00fc hallerde Aile ve Sosyal Hizmetler Bakanl\u0131\u011f\u0131 denetim elemanlar\u0131nca denetlenir.<\/p>\n<p><strong>Defter ve belgelerin ibraz\u0131<\/strong><\/p>\n<p><strong>MADDE 17 \u2013<\/strong>\u00a0(1) Korumal\u0131 i\u015fyerleri, denetimlerde ilgili her t\u00fcrl\u00fc bilgiyi vermek ve bu bilgilerin do\u011frulu\u011funu ispata yarayan defter, kay\u0131t ve belgeleri ibraz etmek zorundad\u0131r.<\/p>\n<p><strong>Y\u0131ll\u0131k faaliyet raporunun d\u00fczenlenmesi<\/strong><\/p>\n<p><strong>MADDE 18 \u2013<\/strong>\u00a0(1) Korumal\u0131 i\u015fyerleri, bir y\u0131ll\u0131k \u00fcretim, istihdam, sat\u0131\u015f, ba\u011f\u0131\u015f, yat\u0131r\u0131m, pazarlama, stok, istihdam etti\u011fi personel gibi bilgileri i\u00e7eren faaliyet raporunu her y\u0131l\u0131n Mart ay\u0131 i\u00e7erisinde Aile ve Sosyal Hizmetler \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fcne iletir.<\/p>\n<p><strong>Korumal\u0131 i\u015fyeri stat\u00fcs\u00fcn\u00fcn sona erdirilmesi<\/strong><\/p>\n<p><strong>MADDE 19 \u2013<\/strong>\u00a0(1) Korumal\u0131 i\u015fyerleri, bu Y\u00f6netmelikte belirtilen ko\u015fullar\u0131n bir veya birka\u00e7\u0131n\u0131 yerine getirmedi\u011fi denetim raporlar\u0131 ile tespit edildi\u011fi takdirde Aile ve Sosyal Hizmetler \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan yaz\u0131l\u0131 olarak uyar\u0131l\u0131r.
