font-size: xx-small;\"> 22\u00a0nci\u00a0maddesinin ikinci f\u0131kras\u0131; \u201cTapulama veya kadastro \u00e7al\u0131\u015fmalar\u0131nda tespit d\u0131\u015f\u0131 b\u0131rak\u0131lan tapuda kay\u0131tl\u0131 ta\u015f\u0131nmaz mallar ile kamu kurum ve kurulu\u015flar\u0131na ait yerlerin bu Kanun h\u00fck\u00fcmleri gere\u011fince kadastrosu yap\u0131l\u0131r.\u201d \u015feklinde iken, bu f\u0131kran\u0131n, 22\/2\/2005 tarihli ve <\/span><span style=\"font-family: Verdana; font-size: small;\"><a href=\"http:\/\/www.alomaliye.com\/5304_sayili_kanun_kadastro.htm\"><span style=\"text-decoration: underline;\">5304 say\u0131l\u0131 Kadastro Kanununda De\u011fi\u015fiklik Yap\u0131lmas\u0131 Hakk\u0131nda Kanunun<\/span><\/a><\/span><span style=\"font-family: Verdana; font-size: xx-small;\"> 6\u00a0nc\u0131\u00a0maddesiyle; \u201cTapulama veya kadastro \u00e7al\u0131\u015fmalar\u0131nda tespit d\u0131\u015f\u0131 b\u0131rak\u0131lan kamu kurum ve kurulu\u015flar\u0131na ait yerlerin tescili yap\u0131l\u0131r.\u201d \u015feklinde de\u011fi\u015ftirilmesi nedeniyle, yap\u0131lan bu de\u011fi\u015fiklik do\u011frultusunda, kamu kurum ve kurulu\u015flar\u0131na ait olup kadastro harici b\u0131rak\u0131lan yerler ile Devletin h\u00fck\u00fcm ve tasarrufu alt\u0131ndaki sahipsiz yerlere ili\u015fkin tescil taleplerinin kar\u015f\u0131lanmas\u0131nda uyulmas\u0131 gereken hususlar, \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 (eski Bay\u0131nd\u0131rl\u0131k ve \u0130skan Bakanl\u0131\u011f\u0131) Tapu ve Kadastro Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcnce y\u00fcr\u00fcrl\u00fc\u011fe konulan 12\/4\/2006 tarihli ve 2006\/8 (1624) say\u0131l\u0131 Genelgede a\u00e7\u0131klanm\u0131\u015ft\u0131.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Verdana; font-size: xx-small;\">Buna g\u00f6re de, Devletin h\u00fck\u00fcm ve tasarrufu alt\u0131ndaki yerler ile Hazinenin senetsizden tasarruf etti\u011fi ta\u015f\u0131nmazlardan idari yoldan Hazine ad\u0131na tescil ettirme yetkisi Bakanl\u0131\u011f\u0131m\u0131za ait olanlar\u0131n tescil i\u015flemleri, \u00f6zel kanunlar\u0131nda h\u00fck\u00fcm bulunmamas\u0131 halinde, Bakanl\u0131\u011f\u0131m\u0131zca \u00e7\u0131kar\u0131lan Milli Emlak Genel Tebli\u011fi (S\u0131ra No: 307) ile bu Genel Tebli\u011fin dayana\u011f\u0131 olan \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 (eski Bay\u0131nd\u0131rl\u0131k ve \u0130skan Bakanl\u0131\u011f\u0131) Tapu ve Kadastro Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcnce y\u00fcr\u00fcrl\u00fc\u011fe konulan\u00a012\/4\/2006\u00a0tarihli ve 2006\/8 (1624) say\u0131l\u0131 Genelgeye g\u00f6re yap\u0131lmakta idi.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: Verdana;
